Newsky Limited Warranty term
Warranty clauses: Newsky Tecnologia e Informatica hereinafter Newsky, in order to protect its customers’ investments, ensures all products sold by itself, against manufacturing defects during a specified time and how to use procedure described in this term.
1) Warranty period
I-In cases when the malfunction is confirmed, the customer is entitled to the limited warranty, only when the repair is made during the period of validity stated below:
II-The term of your limited warranty and technical support is 30 days for computers and electronic products, computer related products and accessories, starting from the delivery date, printed on the billing invoice.
Products containing suffix/prefix QUEIMA, REFURBISHED, USED AND USADO are not included in the limited warranty also cannot be repaired, exchanged or refunded;
*Period of original manufacturer`s warranty may differ from Newsky limited warranty and has to be contested by the client himself.
III-The replacement, repair or change of a product, does not imply a new purchase, thus extension or renewal of your Limited warranty is not possible;
Limited warranty is not transferable and can only be driven by the holder featured on the billing invoice.
2) Warranty coverage:
I. Newsky reserves the right to cover limited warranty exclusively inside Japanese territory.
II. During the term and conditions of the limited warranty, we shall only repair or replace the malfunctioning product in cases where the Newsky diagnosis team approves so. *The conditions of the exchange, replacement or repair of a product must follow the standards described in the terms of technical support, which is delivered among with this term e the billing invoice and must be clearly filled in and forwarded with the product.
III. All products shipped by Newsky ® offers insurance covering any problems arising during transportation, where the deadline to trigger the insurance is 48 (forty eight) hours after the delivery time. * Occurrences reported after the deadline cannot be categorized as transportation trouble which exempts Newsky ®, as well as the insurer, responsibility for the current condition of the product;
IV. Upon product withdrawal in our showroom or delivered via carrier (takyubin), the customer is fully responsible of physical integrity (damages) and logistic (presence of all accessories belonging to the purchased product) verification. In case of irregularity we ask the contact within 48 (forty eight) hours counted from the moment of delivery; * Equipment received with seal warranty ruptured follow the same rule, requiring the statement within 48 (forty eight) hours.
V. Newsky reserves the right to only fully cover Limited warranty for products containing the billing invoice, original packaging, manuals, certified warranty, cables, adapters, disks CD installation and other accessories in perfect condition (as delivered in the act of purchase), following standard rules from manufacturer’s warranty and suppliers;
VI. During the term and conditions of the limited Warranty, the defective parts are replaced for new or rebuilt parts, with an equivalent or superior technology, respecting the specifications from the original product and the applicable country legislation. Replaced parts will be properly installed or delivered and all defective parts replaced during the limited warranty procedure will be returned to Newsky as properties of the company.
VII. Newsky will not give in or borrow any alternative products in any case, during the inspection and services of the warranty coverage handled to the support division;
VIII.Amounts referring to transportation, travels costs, off-duty or caused damages will not be refunded in any case. Includes values related to telephone communication or other charges not covered herein this term;
Total loss of limited warranty is characterized when the problem occurs due to:
→ Improper installation or local conditions;
→ Misuse, abuse, falls, negligence, imprudence or inexperience in the use or handling of the product;
→ The preceding item includes cases such as burns overclock (above parameters settings established by the manufacturer), hot swap (components replacement with running equipment), BIOS and Firmware updates;
→ Violation evidence, modification, components replacement, adjustments or repairs performed by unauthorized personnel;
→ The preceding item includes cases such as total or partial breach of the warranty seal;
→ Physical damage (dents, scratches, manuscripts, mischaracterization, components burned by electrical discharge);
→ Damage caused by natural events like electrical discharges (lightning), floods, fires, landslides, earthquakes, etc...;
What is not covered by the limited warranty;
→ Consumable parts, such as batteries, bags, suitcases, supplies, and other products that have variable lifetime;
→ Cleaning, cosmetic repair or natural wear and accessories, according to manufacturer defined lifetime;
→ Poor functionality due to inexperience or lack of skill during usage;
→ Software (windows programs and devices) which may have problems due to third-party source (viruses, software installation, and driver updates programs), BIOS or firmware updates as well as Operating system (Example: Windows);
→ Damage caused by accessories which was not commercialized or approved by Newsky;
→ Damages caused by product failure or product performance, including, but not limited to, profits lost, financial losses and productivity limitations, resulted from hypothetically related acts to this limited warranty suspension;
→ Any other matter which is not considered as manufacturing malfunction by Newsky or the product manufacturer;
3) Checking and Return:
Newsky ® will accept the return or exchange for manufacturing defects or disagreement with advertised product under the following conditions:
I. Only new or sealed products (no signs of use or handling) will be accepted for exchange, returned within seven (7) days from the delivery date, without recovery of the stock replacement rate;
II. Only new or sealed products (no signs of use or handling) will be accepted for return, returned within seven (7) days from the delivery date, with the recovery of the stock replacement rate, equivalent to 10% (ten percent) of the value of the product, without consideration of discounts;
III. We accept opened product exchange, as long as they contain billing invoice, original packaging, manuals, warranty certificates, cables, adapters, disks / CDs installation, and other accessories, in perfect condition (as delivered upon purchase), returned within seven (7)
days, counting from the date of delivery, by charging the replacement rate depreciation and stock, equivalent to 15% (fifteen percent) of the value of product without consideration of discounts. * Except for software that will be accepted only when new or factory sealed;
IV. Return of opened product is acceptable, containing billing invoice, original packaging, manuals, warranty certificates, cables, adapters, installation disks / CDs, and other accessories, in perfect condition (as delivered upon purchase), returned within seven (7) days
counting from the date of delivery, by charging the replacement rate depreciation and stock, equivalent to 20% (twenty percent) of the value of the product without
consideration of discounts. * Except for software that will be accepted only when new or factory sealed;
Upon return or exchange, the product must be sent with paid postage to our Showroom in Komaki and will be verified by our technical support team concerning integrity and approval of exchange or refund. Any amounts paid for the products will be returned via bank deposit within seven (7) business days or by credit towards a future purchase to be made for a maximum period of 30 (thirty) days from the return date.
In none of the cases above mentioned will be refunded the amount for the product shipping and will be also deducted, when charged, the rate of service charged by the financial institution over the deposit at the time of values reversal per return.

Terms of Service Technical Assistance Newsky
Newsky ® in order to optimize its customer’s experiences provides technical assistance to the purchased equipment. Read below about how to proceed to use this service:
1) Transportation and Inspection:
I. Customer is entirely responsible for delivering the product at the ShowRoom Komaki, in perfect condition for the inspection by our maintenance team , including packing and shipping, which must be prepaid by the customer in case of transmission equipment by mail or carrier.
* Newsky ® reserves the right not to accept any submissions to be charged at delivery, products sent without prior authorization will be returned automatically by carrier, can be collected additional fee to return to sender;
II. All delivered equipment shall contain invoice billing, original packaging, manuals, warranty certificates, cables, adapters, installation disks / CDs, and other accessories, in perfect condition (as delivered upon purchase);
III. Customer is responsible for the data stored on storage devices or removable drives delivered to our technical department, as well as the implementation of previous backups, due to the possibility of loss during inspection or repair;
IV. After receiving the equipment, a period from three (3) to seven (7) business days is required due to analysis and diagnosis of the possible problem to inform the customer;
2) Exchange, return and Limited warranty coverage
I. Only new or sealed products (no signs of use or handling) will be exchanged, returned within seven (7) days from the delivery date, without recovery of the stock replacement rate collection;
II. . Only new or sealed products (no signs of use or handling) will be accepted as returned to seller item, returned within seven (7) days from the delivery date, recovery of the stock replacement rate will be collected, equivalent to 10% (ten percent) of the value of the product, without consideration of discounts;
III. Opened products exchange shall be accepted, containing the billing invoice, original packaging, manuals, warranty certificates, cables, adapters, installation disk/ CDs, and other accessories, in perfect condition (as delivered upon purchase), returned within seven (7) days, counting from the delivery date, by charging the replacement rate depreciation and stock, equivalent to 15% (fifteen percent) of the value of the product, without consideration of discounts. * Except for software that will be accepted only when new or factory sealed;
IV. Opened products return shall be accepted, containing the billing invoice, original packaging, manuals, warranty certificates, cables, adapters, installation disk/ CDs, and other accessories, in perfect condition (as delivered upon purchase), returned within seventy two (72) hours, counting from the delivery date, by charging the replacement rate depreciation and stock, equivalent to 20% (fifteen percent) of the value of the product, without consideration of discounts. * Except for software that will be accepted only when new or factory sealed;
V. Upon product return or exchange the item(s) will be inspected concerning integrity and approval for an exchange or return. The values eventually paid for the products will be returned via bank deposit within seven (7) business days or credited to a future purchase to for a maximum period of 30 (thirty) days from the return date;
VI. In none of the cases above mentioned the amount for the shipping will be refunded and also deducted, when charged, the service fee by the financial institution trough the bank deposit upon reversal of values per return.
VII. In case of inspection problem not covered by the Limited Warranty a service fee for inspection will be charged by Newsky ®, ¥ 2,000 (two thousand yen) and / or the values of inspection, adding the sum for transportation (takkyubin) of inspection for authorized personnel by the manufacturer, when necessary, even in products in term of Limited Warranty;
3) Implementation services, exchange and repairs
I. The deadline for the execution of repairs or maintenance is three (3) to seven (7) business days for equipment manufactured by Newsky ® and three (3) to 45 (forty
five) days to other manufacturers' equipment.
II. After the repair, the equipment sent for maintenance must be taken or received by carrier within sixty (60) days otherwise it will be considered abandoned. * Newsky ® reserves the right to charge the expenses related to inspection, repair and recycling equipment.
We consider customer agreement to these terms from the time you send your equipment for maintenance;
4) Restrictions
I. Newsky will not give in or borrow any alternative products in any case, during the inspection and services of the warranty coverage handled to the support division;
II. Amounts referring to transportation, travels costs, off-duty or caused damages will not be refunded in any case. Includes values related to telephone communication or other charges not covered herein this term;
III. Services are not covered by the Limited Warranty ® Newsky, only the parts follow the rules outlined in the Statement of Limited Warranty Newsky ®;
