TERMS OF USE NEWSKY MOBILE - NTT DOCOMO

 

NEWSKY MOBILE (1GB / 3GB / 5GB / 10GB / 30GB) - VERSION 3.0 - ENGLISH (15.08.2017))
1. SERVICE

A) Newsky Mobile is indicated for use of applications like WhatsApp, Facebook Messenger, Skype among others. And also make and receive calls through the Brastel 050 application or other IP Phones.
B) Internet SIM Card (1GB, 3GB, 5GB, 10GB or 30GB), available where there is 4G / 3G Docomo coverage. We are not responsible for signal failure in certain areas;
C) The customer must own or acquire a SMARTPHONE or UNLOCKED TABLET (or DOCOMO, without pending bills)  3G / 4G system;
D) There is no daily internet usage limit, and after reaching the contracted GB limit, the speed will be reduced, maximum of 128 Kbps until the end of the month. The plan is described in your invoice;
E) No change (cut, forced adaptation, etc.) in the format of the SIM CARD is allowed;
F) Receiving SMS is unlimited and free, NewSky offers free delivery of up to 50 SMS messages only within Japan (domestic sending), after this amount, there is a cost per message sent of ¥ 30 within Japan And ¥ 200 international; Be careful when sending messages via SMS, as there may be a cost. We recommend using apps such as WhatsApp, Messenger, Skype, etc .;
G) In case of suspension of the service due to accident, unscheduled maintenance, emergency, there will be no reimbursement for the time of service unavailability;
H) NewSky reserves the right to pass on to the customer any changes requested by the operator without prior notice, including adjustments of amounts, if any;
I) The speed may vary significantly according to day periods, network congestion and according to the user environment (such as terminal device specifications), reaching a maximum of 1 Mbps.
1.1. VOICE APPLICATION 
A) We recommend using the Brastel 050 application. With it, it`s possible to make and receive calls (national and international);

2. PAYMENT
A) Monthly prepaid system with automatic renewal through payment of the monthly fee, with credit card or Smart Pit card (in convenience stores - kombini), the Smart Pit card will be sent along the SIM card. (Every month the customer will use the same card);
B) DATE OF INVOICE deadline: 20th OF EACH MONTH, WITH MAXIMUM PAYMENT PERIOD until the 25th of the same month;
C) If the payment is not made until the maximum period, the SIM Card will automatically be canceled at 23:59 on the last day of the month, and there will be no possibility of reactivation. To use the service again you will need to sign up for a new contract.
D) To cancel the service, just do not pay the next invoice and return the SIM CARD until the 7th day (the SIM is lent at no additional cost during the use of the service);
E) Payment rate ¥ 200 - Due to the launch promotion of this service, NewSky will pay the collection fee of ¥ 200 until December 2017. By January of 2018 the fee will be returned to the invoice.

 

3.1. CHANGE OF PLAN

A) It is possible to increase or reduce the amount of GB within your plan. To do this, you must request between 01 and 05, so that it is changed the following month. (Fee of ¥ 2,000)
B) It is not possible to change a DATA plan for DATA + SMS or vice versa. In this case a new contract must be made.
4. CONTRACT
A) Monthly or quarterly contract (3 months contract);
B) Documents required for the contract: - copy of the front and back of the zairyu card with the address updated; - copy of the passport (pages 1, 2 and 3);
C) In case of change of address the customer must inform NewSky immediately. The register must always be updated;
D) The SIM card is non-transferable. If the customer passes the SIM CARD to third parties, it may suffer legal consequences;
E) NewSky's communication with customers is made through SMS, Facebook, WhatsApp, email or telephone;
F) If you terminate the contract with NewSky and leave pending fees, eg, non-payment for sending SMS, and do not hold the resolution by immediate payment of the amounts, the client's documents and general information will be sent to Libra Legal Office, being from that moment responsible for the case; In addition, your name may be registered with the Japan CREDIT PROTECTION SERVICE;
5. LOSS OR THEFT

A) In the event of loss or theft, the client must notify NewSky immediately;
B) In case of loss of the SIM CARD  provided by NewSky, the customer must immediately make POLICE REPORT and send to NewSky. * This process is mandatory in case of loss or theft of SIM card cell phone number.
C) There will be a fee of ¥ 3,240 + SHIPPING, if any, to enable a new SIM CARD. Replacement will be made within 7 business days;
6. CANCELLATION 
A) The SIM is prepaid and the contract is monthly and can be terminated at any time by the customer;
B) Upon termination of the contract, the SIM Card must be returned to NewSky by the 7th day of the month following the last month of payment.
7. SUSPENSION RIGHT

A) If you have financial problems with NewSky, it reserves the right to suspend any additional service on behalf of the holder until the pending issues are resolved;
B) NewSky reserves the right to unilaterally suspend or cancel the client's agreement if it causes harm to the company or in case the company judges misuse or misconduct on the part of the client, without prior notice and without reimbursement;
8. SUPPORT
A) NewSky is not responsible or offer technical support for software and applications used by the customer;
B) NewSky Mobile uses the NTT DOCOMO network, but all support is exclusively offered by Newsky, where DOCOMO disclaims liability.
C) Service for technical support or questions related to late payment will only be resolved within the office hours of the responsible department. Monday to Friday from 10:00 a.m. to 5:30 p.m.
D) The technical support for using the Brastel application (050) will be exclusively provided by Brastel. NewSky does not offer technical support for this occasion.

* Please note that as of January 2016, Japanese data traffic control laws have become increasingly rigid. New rules from carriers or government may occur without notice.
